Les Enterprises Yvon Bessette is a private company and is incorporated by virtue of The Quebec Companies Act. (The enterprise Yvon Bessette, hereafter called Bessette). If you wish to obtain information or clarification regarding the procedure for handling your leguminous goods, we recommend that you contact our advisors.

1. The Role of Bessette
We provide loading and unloading services of: containers, transport and storage. Our specialty is the handling of dry and leguminous goods.

2. Responsibilities
It is your responsibility to gather all necessary information regarding transportation of your merchandise. We are not responsible for breakage, damage or loss of your goods until they arrive at our facilities. We take charge of your goods in the state in which they were received. If we observe a major defect or the status your merchandise is in jeopardy, we will contact you to advise you.

3. General conditions for wholesalers and/or suppliers
The general conditions for wholesalers and suppliers generally include fees in case of cancellation or changes to your purchases.

4. Prices and other information
All prices mentioned are in Canadian dollars, unless the opposite is expressed, and do not include federal and provincial taxes.

5. Cancellation of a purchase
If you wish to cancel your delivery, you must immediately contact us by phone. Under no circumstances are you to send email or leave a message in a voice mailbox without a response. This will cancel your projected delivery. Once your delivery is completed and confirmed, you are subject to any cancellation or modification fees which wholesalers and suppliers may impose.

6. Infringement of the site’s rules of use
Bessette prohibits, under penalty of prosecution, any use of its site for illegal or fraudulent purposes.

7. Confidentiality
Bessette is committed to respecting the privacy of its customers and therefore will not sell to any third party the names of individual clients, nor other information from personal profiles.

8. Copyright/trademarks
All content is protected by Canadian and international copyright laws. It is therefore forbidden to modify, copy, distribute, transmit, expose, present, reproduce, publish or transfer any information, software, products or services obtained from the Bessette site, or use them to create works derived or licenses, or to use any or the other site elements for commercial purposes or otherwise.

9. Laws and regulations
The present conditions and their applicable laws and regulations are governed by the laws of the Province of Quebec without regard to provisions set out by law. The client user accepts and recognizes the exclusive jurisdiction of the courts of the Province of Quebec, District of Montreal, for any litigation arising from the use of this site or these terms and conditions.

10. Damages resulting from access to our site
Bessette, nor any third party supplier, is not responsible for any virus or damages, whether direct or indirect, exemplary, punitive or any bodily or moral injury resulting from the use of its site.

11. Assignment
You may not assign, alienate, subcontract or delegate your rights, duties or obligations pursuant to these presents.

12. Modification
Bessette reserves the right to change these terms and conditions at any time. Your use of this site will be governed by the terms then in effect at the time of your use.

13. Topic titles
Topic titles used in these general terms and conditions re intended to facilitate consultation and cannot in any way restrict or otherwise modify the terms of this agreement.

14. Integrity of the agreement
The present general conditions, as well as the conditions integrated or mentioned constitute the entire agreement between us regarding the subject hereof, and supersede all prior agreements, oral or written) regarding the subject hereof, and cannot be changed by writing or by the posting of this change on this site.

15. Severability
The present conditions shall be deemed to not be severable. If any provision is deemed neither enforceable or inoperative, this provision will nevertheless be applied to the extent permitted by applicable law, and this decision will not affect the validity and enforceability of the remaining provisions.
